Why is Web Accessibility Critically Important?

1. It is the Law

Accessibility is not optional. It is a federal mandate. The U.S. Department of Health and Human Services (HHS) enforces strict compliance with Section 504 of the Rehabilitation Act and Title II of the ADA, requiring all government entities to provide comparable access to information and services for individuals with disabilities.

2. Updated Compliance Deadlines

On April 20, 2026, the Department of Justice published a temporary final rule extending the compliance deadlines. According to the Federal Register (Docket No. 2026-07663):

State/local governments with a population ≥ 50,000: Deadline extended to April 26, 2027.

State/local governments with a population < 50,000 or special district governments: Deadline extended to April 26, 2028.

3. HHS Deadlines for Federal Fund Recipients

HHS also extended deadlines for entities receiving HHS funding:

15+ employees: Extended to May 11, 2027.

Fewer than 15 employees: Extended to May 10, 2028.

4. The Technical Standard

All compliance requirements are measured against the WCAG 2.1 AA (Web Content Accessibility Guidelines) standard - an internationally recognized benchmark covering Perceivability, Operability, Understandability, and Robustness.

What Are the Risks of Non-Compliance?

Failing to meet these accessibility requirements exposes your entity to serious consequences:
1. Lawsuits and Legal Actions

Inaccessible digital content invites federal lawsuits, class-action claims, civil rights complaints, and costly consent decrees. With enforcement rising, non-compliant entities are prime targets.
2. Loss of Federal Funding

State and local governments that accept HHS or other federal funds must demonstrate compliance. Failure to do so can result in suspension or termination of federal financial assistance.
3. Reputational Damage

Excluding citizens with disabilities damages public trust. It signals that your agency does not value inclusion, harming your credibility and community standing.
4. Excluding Millions of Citizens

With over 1.3 billion people globally experiencing significant disability and millions in the U.S. alone, inaccessible services effectively cut off a vast segment of the population from healthcare, education, emergency alerts, social benefits, and employment resources.
